Newspaper clipping from the Tulsa Daily World published July 23, 1921 and entitled "Judge Cole's Instructions to Gustafson Jury." This article contains an overview of the instructions given to the jury deliberating testimony in the trial against suspended Tulsa Police Chief John A. Gustafson. District Judge Redmond S. Cole provided the instructions on July 22, 1921 concerning two counts against Gustafson. His instructions provided an overview of the duties of a public officer of the law, the definition of willful negligence, and information concerning the theft of automobiles in the alleged automobile insurance conspiracy. The judge also told the jury that Gustafson was not to be held liable for any looting, unlawful or wrongful act on the part of other officers unless the act was committed in the chief's presence or under his direct order. The opposite side of this clipping contains a second article entitled "Chief Found Guilty On Two Counts; Verdict Returned After Six Hours Of Deliberation." This article reports upon the conviction of former Tulsa Police Chief John A. Gustafson on two counts after six hours of jury deliberation. On the first count, the jury found him guilty of failing "to take the proper precautions for the protection of life and property during the rioting." The jury vote was unanimous. On the second count, ten of the twelve jurors found Gustafson guilty of a conspiracy to free automobile thieves and collect insurance company rewards. The article lists the names of the jurors and how they voted. The report also mentions that although the conviction contains no criminal conviction, Gustafson will loose his position as Tulsa Chief of Police. The remainder of the article contains a recap of the closing remarks by the prosecution and defense prior to jury deliberation. |
